News reports have revealed that Kim Kardashian and Kanye West will not be facing criminal prosecution after all and here's why.

TMZ reports that the couple would be getting away with the release of the recorded phone conversation between Taylor Swift and Kanye simply because she had no expectations of privacy.
It was earlier reported that Swift's attorney had already threatened Kanye with prosecution in February, months prior to the release of the recorded phone call on Sunday, July 17.
Although the state of California sees the recording of a private conversation within the state without the other party knowing about it, as a felony, this does not extend to "confidential communication" that may have been over heard.
Apparently, Swift had known that the conversation would be overheard seeing as the call was done on speaker phone and producer, Rick Rubin, as well as members of the crew who were recording Kanye, spoke up several times during the call.

The fact that Swift knew other people had overheard the conversation becomes the fly in the ointment of her lawsuit, which has been effectively made null and void.
